6.1. Availability of the Service

The access to the Portal requires services and provisions of third parties, including transportation through telecommunications networks with reliability, quality, continuity and functioning not corresponding to Xeridia. Consequently, the services provided through the Portal may be suspended, cancelled or become inaccessible, previously or simultaneous to the portal service delivery.

Xeridia is not liable for damages or prejudices of any type produced in the Users caused by failures or disconnections in the networks of telecommunications that it produces the suspension, cancellation or interruption of the Portal service during its provision or previously.

6.2. Information

Access to the Portal does not imply the obligation by Xeridia to prove the veracity, exactitude, adaptation, suitability, exhaustivity and updating of the information supplied through it. The contents of this page are of general nature and do not constitute, in any way, the provision of services of any type, so that this information is insufficient for the Users to make personal or company decisions.

Xeridia is not liable for the decisions made from the information supplied in the Portal or damages and prejudices to Users or third parties produced due to actions that have as their sole foundation the information obtained in the Portal.

6.3. Contents and services linked through the Portal

The Portal access service includes technical devices for links, directories and search engines that allow the Users to have access to other pages and Internet portals (hereinafter, ’ Linked Sites ’). In these cases, Xeridia acts as intermediary service provider in compliance with Article 17 of law 34/2002, of July 12, of the services of the Information and Electronic Commerce Society (LSSI) and will only be responsible for the contents and services provided in the Linked Sites to the extent that it has effective knowledge of the illegal nature and has not deactivated the link with due diligence. If the Users consider that there is a Linked Site with illegal or unsuitable contents this may be reported to Xeridia pursuant to the procedures the effects established in Clause 6, without this communication in any case involves the obligation to remove the corresponding link.

In no case does the existence of Linked Sites presuppose the existence of agreements with their administrators or owners, or the recommendation, promotion or identification of Xeridia with the declarations, contents or services provided.

Xeridia does not know the contents and services of the Linked Sites and therefore is not responsible for the damages produced by the illegal nature, quality, failure to update, unavailability, error and lack of utility of the contents and/or services of the Linked Sites or for any other damage that is not directly imputable to Xeridia.

6.4. Service quality

The access to the Portal does not involve the obligation by Xeridia to monitor the absence of virus, worms or any other hazardous computer element. In any case, the Users are responsible for the availability of suitable tools for the detection and disinfection of hazardous computer programs.

Xeridia is not liable for the damages produced in the computer equipment of the Users or of third parties during the portal service delivery.
